Die Auseinandersetzung um die Problematik des Suizids ist üblicherweise an den Kategorien von Recht und Unrecht orientiert. Ausgehend von Spinozas Ontologie der Macht, die Selbsttötung als unmöglich ausschließt, wird die Debatte hier in die Frage nach einem ursprünglichen Können der Negation der Selbsterhaltung verschoben. Dies erlaubt, sowohl den Zwiespalt der Medizin zwischen Autonomie oder Pathologie der suizidalen Handlung als auch das exemplarische Suizidverbot bei Kant und Hegel kritisch zu durchleuchten und die moralische Konfliktdimension der Selbsttötung am Ende einer neuen (...) Ziel dieser Untersuchung ist es zu zeigen, wie Platons Verständnis von Lust und Unlust in seinem Dialog Philebus mit Spinozas Theorie der Affekte zusammenhängt. Beide Denker verstehen den Affekt der Lust in Relation zu Werturteilen und dem Charakter einer Person. Ich behaupte, dass Platon und Spinoza gleichermaßen feststellen, dass die Wahl des Individuums für lustvolle Objekte von der Definition und Bestimmung des Guten und des Ideals des Individuums selbst abhängt, und somit auch von der Ursache der Lust. Beide (...) Philosophen stimmen darin überein, dass sich das Vergnügen eines vernünftigen Menschen von dem eines unvernünftigen unterscheidet, da auch ihr Urteil über Gut und Böse jeweils unterschiedlich ist. Ich schließe, dass Platons und Spinozas Bild eines vernünftigen Menschen im Zusammenhang mit den Affekten der Lust und des Unlustempfindens übereinstimmt, weil es hierbei um ein ganzheitliches Bild vom Menschen geht, der Affekte nur entsprechend seiner Natur oder seines Wesens erlebt. English summary: A commentary on Spinoza's final work, Tractatus Politicus has until recently remained a desideratum. In contrast to his metaphysics and his philosophy of religion, Spinoza's theories on politics, the state and law have received little attention in the German-speaking countries. It's only recently that Spinoza's political philosophy again become widely discussed in Germany. Having established the role of political philosophy and working always within the context of Spinoza's complete work, this volume comments firstly on Spinoza's theory on the (...) natural genesis of law and the state, including the foundations of political philosophy, the relationship between natural and national law and the theory of sovereignty and international relations. Continuing on this basis it moves on to his concept for the optimization of the system of political and legal institutions in all three forms of government. Finally, there is an analysis of the current relevance of Spinoza's thought and its impact on current debate. Spinozas These „Wer eine wahre Idee hat, weiß zugleich, dass er eine wahre Idee hat“ hat zahlreiche Interpreten dazu bewogen, ihm eine ernsthafte Auseinandersetzung mit dem Skeptizismus abzusprechen. Es scheint, als würde er die zentrale Frage, welche unabhängige Garantie wir für die Wahrheit einer Idee haben, einfach ignorieren. Gegen diese Auffassung wird argumentiert, dass sich Spinoza durchaus der skeptischen Herausforderung stellt, und zwar indem er eine theoretische Diagnose formuliert: Der Skeptiker nimmt irrtümlicherweise an, Ideen seien isolierte, von körperlichen Zuständen (...) getrennte Repräsentationen, für die je einzeln eine Garantie gesucht werden muss. Spinoza versucht diese Annahme zu korrigieren, indem er eine holistische, monistische und externalistische Theorie von Ideen entwirft: Eine Idee lässt sich nur erklären, wenn sie einerseits in ihrer Verkettung mit anderen Ideen und andererseits mit Blick auf die körperliche Grundlage erfasst wird. Dann zeigt sich, dass die Garantie für die Wahrheit einer Idee im körperlich verankerten Ideennetz und nicht in einer übergeordneten Instanz liegt. (shrink)

Welche Auffassung von Wahrheit vertritt Spinoza? Spinoza Interpreten haben diese Frage jeweils ganz unterschiedlich beantwortet. Das erstaunt, da Spinoza zu Beginn seiner Ethik klar sagt, dass die Wahrheit einer Idee in der Übereinstimmung mit ihrem Gegenstand besteht, und sich damit auf eine Korrespondenztheorie der Wahrheit verpflichtet. Die Uneinigkeit über das richtige Verständnis von Spinozas Wahrheitstheorie hängt von seiner zentralen und notorisch schwierigen Ideentheorientheorie ab, der eine angemessene Rekonstruktion von Spinozas Wahrheitskonzeption gerecht werden muss. All die ideentheoretischen Eigenheiten – (...) wie das enge Verhältnis zwischen Adäquatheit und Wahrheit, die Theorie der zwei Objekte einer Idee und die Parallelismusthese – stellen Schwierigkeiten für eine korrespondenztheoretische Interpretation von Spinozas Wahrheitstheorie dar. Dennoch werde ich dafür argumentieren, dass Spinoza ernst genommen und ihm eine Korrespondenztheorie der Wahrheit zugesprochen werden sollte. Dafür werde ich zeigen, dass sich Spinozas ideentheoretische Eigenheiten und ihr gegenseitiges Verhältnis zueinander so rekonstruieren lassen, dass sie einem korrespondenztheoretischen Wahrheitsverständnis nicht zuwiderlaufen. Thema dieser Studie ist die Philosophie des Geistes bei Descartes, Malebranche, Spinoza und Leibniz. Es soll gezeigt werden, dass die Frage nach dem Wesen des Geistes bei diesen Autoren von vorneherein im Kontext einer erkenntnistheoretischen Problematik behandelt wird und erst dadurch ihr eigentümliches Profil erhält. Wie muss der menschliche Geist beschaffen sein, wenn sichere Erkenntnis möglich sein soll? Das ist die zentrale Frage, die im frühneuzeitlichen Rationalismus gestellt wird. Sie wird von den Autoren des klassischen Rationalismus in mehreren monumentalen Anläufen (...) beantwortet, indem der menschliche Geist als etwas beschrieben wird, das wesentlich auf Gott und seine Allwissenheit bezogen ist. In radikalisierender Anknüpfung an die scholastische Philosophie erweist sich die visio beatifica, die es dem endlichen Geist erlaubt, an Gottes Unendlichkeit teilzuhaben, als das zentrale epistemologische Paradigma, das von den genannten Autoren auf je unterschiedliche Weise ausbuchstabiert wird. So zeigt sich, dass die Philosophie des Geistes, weit davon entfernt, eine bloße Subdisziplin der Philosophie zu sein, für die rationalistischen Philosophen des 17. Jahrhunderts ins Zentrum der prima philosophia rückt - als die privilegierte Schnittstelle, an der sich Erkenntnistheorie, Religionsphilosophie und Subjektivitätstheorie treffen und wechselseitig artikulieren. Im ersten Teil stehen die Begriffe der Freiheit und des Willens bei Kant im Mittelpunkt. Der zweite Teil untersucht detailliert die Kernpunkte der kantischen Ethik: den (letztlich gescheiterten) Versuch, Freiheit und Naturkausalit t auszus hnen, und die Theorie des Handelns nach Moralgesetzen, deren Wahl den freien Willen als eigentliches Moment ausmacht. Am Ende steht die Einsicht in ein hoch entwickeltes, differenziertes (...) gedankliches System, das unserer Alltagsauffassung von moralischer Verantwortung erstaunlich nahe kommt. (shrink)

Ausgehend von Max Stirners Kritik an Sokrates' moralischer Entscheidung, aus dem Kerker nicht zu entfliehen, zeichne ich seine Theorie des Menschen nach. Dazu wird zunächst – in Anlehnung an Bernd A. Laska – Stirners Analyse des Zustandekommens der kritisierten Moral genauer betrachtet, um dann, vor allem anhand des Aufsatzes _Das unwahre Prinzip unserer Erziehung_, die Voraussetzung dieser Kritik herauszuarbeiten. Als Resultat ergibt sich, dass Stirners These, der Einzelne sei nicht nur Teil des Ganzen, sondern das Ganze selbst, wohl von (...) Hegel inspiriert ist und dennoch in einem entscheidenden Punkt über Hegel hinausgeht. Abschließend gehe ich auf das Problem von Recht und Gewalt in _Der Einzige und sein Eigentum_ ein. (shrink)

In dem vorliegenden Beitrag rekonstruiere ich die linkslibertaristische Kritik des Rechts zu vererben, die Hillel Steiner ausgearbeitet hat, und prüfe, ob diese Kritik zufriedenstellend ist. Ich komme zu dem Ergebnis, dass Steiner in dem von ihm angelegten rechtstheoretischen Rahmen die von vielen Philosophen und Rechtswissenschaftlern angenommene rechtliche Gleichartigkeit des Vererbens und des Verschenkens mit überzeugenden Argumenten in Frage stellt, seinerseits aber das Recht zu vererben mit einer Theorie kritisiert, die gerechtigkeitstheoretische und sozialtheoretische Bedenken hervorruft. Wie ich abschließend darlege, geben (...) die erzielten Untersuchungsergebnisse Aufschluss über das ontologische Profil des Rechts zu vererben und die Eigentümlichkeit dieser Art der Eigentumsübertragung; sie eignen sich deshalb als Ausgangspunkt einer philosophischen Theorie des Erbrechts. ABSTRACT The aim of this paper is to investigate the intertextual relationship between Spinoza and Tacitus in the Political Treatise, underlining how Spinoza uses Tacitus’ quotes against his main political enemy: Tacitism. I will show that Spinoza’s use of Tacitus is very selective and can be aptly characterized as a twofold political use: Tacitus’ quotes shape Spinoza’s political insights, but they are also used to confront Tacitism. To develop this twofold reading, after a brief introduction, I will consider Tacitus’ reception (...) in Early Modern period, describing Tacitism and its political standpoints. Then, I will analyse Spinoza’s use of Tacitus, considering his approach to three core themes: the nature of peace and sedition, the nature of the masses and the use of secrets (arcana). Finally, I will draw a comparison between the use to which Tacitus’ quotes are put by Spinoza on the one hand and by the Tacitists on the other, stressing how this comparison contributes to our understanding of their opposed political positions: democracy for Spinoza and monarchy for the Tacitists. Les tacitistes utilisent l’œuvre de l’historien pour en extraire des conseils aux gouvernants. Hobbes et Spinoza se servent au contraire des récits de Tacite comme matériaux pour constituer leur théorie des affects et expliquer le rôle que jouent ceux-ci dans la politique. Dans leur structure théorique, ils donnent aux exemples une fonction confirmative et une fonction anthropologique ; Spinoza leur donne en outre une fonction anticipatrice.
